Effective date: January 1, 2024
These Coaching Terms & Conditions (“Terms”) apply to all coaching services provided by Stephenie Zamora Media, LLC dba Choose Your Calling (“Coach,” “we,” “us,” or “our”) to individuals who book or purchase coaching services (“Client,” “you,” or “your”). By booking and/or paying for a coaching session or package, you acknowledge that you have read, understood, and agreed to these Terms.
1. Coaching Services
Coaching is a collaborative process designed to support you in areas such as personal growth, self-discovery, healing and self-awareness, purpose and passion, relationships, decision-making, goal setting, career and business development, branding and marketing strategy, and other areas agreed upon between you and the Coach.
Coaching may include conversation, reflection, questions, exercises, resources, strategic guidance, accountability, and other tools or practices intended to support your goals.
Coaching is not a guarantee of any particular outcome. Your results depend on many factors, including your participation, decisions, circumstances, and actions.
You understand that coaching is a collaborative relationship and that you remain solely responsible for your own choices, decisions, actions, and results.
2. Coaching Is Not Therapy, Medical, Legal, or Financial Advice
Coaching is not psychotherapy, mental health counseling, medical treatment, diagnosis, or other healthcare. It is also not legal, financial, investment, tax, or other professional advice. The Coach is not acting as your doctor, therapist, psychiatrist, psychologist, lawyer, financial advisor, or other licensed professional. Nothing provided through coaching, including conversations, exercises, resources, recommendations, or other materials, is intended to diagnose, treat, or prevent any medical or mental health condition or to replace professional advice. You agree to seek the appropriate qualified professional whenever you need medical, mental health, legal, financial, or other specialized assistance. If you are experiencing a mental health or medical emergency, please contact an appropriate emergency or healthcare professional rather than relying on coaching services.
3. Client Responsibility
You acknowledge that you are responsible for your own decisions, choices, actions, and outcomes. The Coach may provide observations, questions, perspectives, strategies, suggestions, and resources, but you are under no obligation to follow any particular recommendation. You agree to communicate openly and honestly to the extent you feel comfortable and to take responsibility for determining what is appropriate for you. You understand that coaching cannot guarantee specific personal, professional, financial, relationship, health, or business results.
4. Scheduling and Attendance
Your coaching session will take place on the date and time selected when booking.
Please arrive on time and be in a location where you can participate privately and without unnecessary distractions. If you arrive late, your session will still end at the originally scheduled time. Any unused portion of the session will not be added to a future session. Each scheduled appointment counts as one session regardless of whether you use the entire scheduled appointment time. If a session needs to be rescheduled, it will be rescheduled based on the Coach’s availability.
5. Cancellation and Rescheduling
If you need to cancel or reschedule a session, please provide at least 24 hours’ notice whenever possible. Cancellations or rescheduling requests made less than 24 hours before the scheduled appointment may result in the session being considered used and non-refundable. If an unexpected emergency or circumstance arises, please contact the Coach as soon as possible. Exceptions may be considered at the Coach’s discretion. If the Coach needs to cancel or reschedule a session, you will be offered the opportunity to reschedule at a mutually agreeable time.
6. Payment and Refunds
Payment is due at the time of booking unless otherwise agreed upon in writing.
Because coaching appointments reserve time specifically for you, payments are generally non-refundable once a session or coaching package has been purchased. Unused sessions may not be transferred, exchanged for cash, or extended beyond the applicable coaching period unless otherwise agreed upon by the Coach in writing. If you purchase a coaching package, the package terms, expiration period, number of sessions, and/or other services included will be communicated at the time of purchase and will form part of your agreement with the Coach.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
7. Communication Between Sessions
If communication between coaching sessions is included with your specific coaching package, the available communication methods and expected response times will be communicated when you purchase the service. Unless otherwise stated, messages are generally answered during normal business hours and may take 24–48 business hours for a response. Communication outside of scheduled coaching sessions is not intended for emergencies or urgent mental or physical health concerns.
8. Confidentiality
The Coach respects your privacy and will make reasonable efforts to keep information shared during the coaching relationship confidential. The Coach will not publicly disclose that you are or have been a coaching client without your permission, except where disclosure is required by law or is reasonably necessary to address a serious safety, legal, or professional obligation.
Confidentiality does not apply to information that:
- Is already publicly available;
- Was known to the Coach independently before being disclosed by you;
- Is received lawfully from another source without a confidentiality obligation;
- You authorize the Coach to disclose; or
- Must be disclosed pursuant to applicable law or legal process.
Please do not share information with the Coach that you expect to be protected by attorney-client privilege or another professional privilege unless you have independently determined that doing so is appropriate.
9. Coaching Materials and Intellectual Property
Any worksheets, exercises, frameworks, templates, recordings, written materials, or other resources provided as part of your coaching experience are intended for your personal use unless otherwise stated. These materials may contain proprietary content belonging to Stephenie Zamora Media, LLC and may be protected by copyright or other intellectual property laws. You may use the materials for your own personal or professional development, but you may not reproduce, distribute, publish, resell, sublicense, teach, or otherwise commercially exploit them without prior written permission.
10. Recordings
Coaching sessions will not be recorded unless recording has been discussed and mutually agreed upon. If a session is recorded, both parties must consent to the recording before it begins. Any recording provided to you is for your personal use only and may not be distributed, published, sold, or shared without written permission.
11. Testimonials and Feedback
You may be invited to provide feedback or a testimonial about your coaching experience. Providing a testimonial is completely voluntary. We will not use your name, photograph, testimonial, or other identifying information publicly without your permission.
12. No Guarantee of Results
Every person and situation is different. While the Coach will provide professional effort, experience, guidance, and support, no specific result or outcome is promised or guaranteed. You understand that the Coach does not control your circumstances, decisions, actions, or results.
13. Limitation of Liability
To the fullest extent permitted by applicable law, you agree that Stephenie Zamora Media, LLC dba Choose Your Calling and the Coach will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your participation in coaching services.
You understand that you are voluntarily participating in coaching and are responsible for evaluating whether any information, suggestion, strategy, exercise, or recommendation is appropriate for you.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
14. Respectful Participation
We are committed to maintaining a coaching relationship based on mutual respect, honesty, and appropriate boundaries. The Coach reserves the right to end a coaching relationship if circumstances arise that make continuing the relationship inappropriate, unsafe, unproductive, or inconsistent with the Coach’s professional boundaries. If the Coach terminates a relationship for reasons other than a Client’s breach of these Terms, any applicable refund or alternative arrangement will be determined based on the circumstances and applicable law.
15. Disputes
If a dispute arises regarding coaching services, both parties agree to make a good-faith effort to communicate directly and resolve the matter before pursuing formal legal action. Nothing in this section prevents either party from exercising rights or seeking remedies that cannot legally be waived. These Terms shall be governed by the laws of the state of New Mexico, without regard to conflict-of-law principles, except where applicable law requires otherwise.
16. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time you purchase coaching services will generally apply to that purchase unless otherwise required by law or agreed upon in writing. The most current version will be published on this website.
17. Entire Agreement
These Terms, together with the description of the coaching service or package you purchased, constitute the agreement between you and Stephenie Zamora Media, LLC regarding the applicable coaching services. If there is a conflict between these Terms and a specific written agreement you have entered into with Stephenie Zamora Media, LLC, the specific written agreement will control to the extent of the conflict.
18. Acceptance of Terms
By booking and/or purchasing coaching services, you acknowledge that:
- You have read and understood these Terms & Conditions.
- You understand that coaching is not therapy, medical care, legal advice, financial advice, or another form of licensed professional care.
- You understand that you are responsible for your own decisions, actions, and results.
- You agree to the scheduling, cancellation, payment, confidentiality, intellectual property, and other policies described above.
- You voluntarily agree to participate in coaching under these Terms.
